Terms of Use

These Terms of Use are provided in English.
These Terms of Use (“Terms”) govern your use of Moonwake (“the app”), developed and operated by Erman Bağbakan (“the developer”, “we”, “us”). By downloading or using the app you agree to these Terms. If you do not agree, please do not use the app.
1. The service
Moonwake is a sleep tracking and smart alarm app for iPhone and Apple Watch. It records and analyzes your sleep locally on your devices, detects snoring through on-device sound analysis, and offers alarm features including a smart wake window on Apple Watch. Feature availability may vary by device, OS version, and whether an Apple Watch is paired.
2. Not medical advice
Moonwake provides lifestyle and sleep-hygiene information based on the data you collect. It is not a medical device, and it does not diagnose, treat, monitor, or screen for sleep disorders or any other medical condition. Scores, stage estimates, and suggestions are informational estimates and may be inaccurate. Always consult a qualified healthcare professional about sleep concerns, and never disregard professional advice because of something shown in the app.
3. Alarms and reliability
We work hard to make alarms dependable, including scheduling system-level alarms that ring even if the app is closed. However, alarm delivery ultimately depends on your device's state (battery, Do Not Disturb and alarm permissions, OS behavior). You are responsible for critical wake-ups: for flights, exams, and similar must-not-miss events, set an independent backup alarm. To the maximum extent permitted by law, we are not liable for losses caused by a missed or delayed alarm.
4. Subscriptions (Moonwake Premium)
Some features require a paid Moonwake Premium auto-renewable subscription, purchased through your Apple ID:
- Plans. Monthly and yearly plans are offered. Current prices are always shown in the app and on the App Store purchase sheet before you buy; prices vary by region and may change for new billing periods with notice through the App Store.
- Free trial. New subscribers may be offered a free trial (currently 7 days). If you do not cancel at least 24 hours before the trial ends, the subscription starts automatically and your Apple ID is charged.
- Auto-renewal. Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple ID account is charged for renewal within 24 hours before the current period ends.
- Managing and canceling. You can manage or cancel anytime in iOS Settings → your Apple ID → Subscriptions (or App Store → your profile → Subscriptions). Deleting the app does not cancel a subscription.
- Refunds. Purchases are processed by Apple; refund requests are handled by Apple under their terms at reportaproblem.apple.com.
- Restoring. Use “Restore Purchases” in the app to re-activate a subscription on a new device with the same Apple ID.
5. Free tier and rewarded ads
The free tier includes core sleep tracking. Some content, such as a night's detailed report, can be unlocked by voluntarily watching a rewarded video advertisement. Ad availability depends on third-party ad networks and is not guaranteed at all times; ad-based unlocks apply to the specific content indicated and do not constitute a subscription.
6. Acceptable use
You agree not to misuse the app — including attempting to bypass payment or ad-unlock mechanisms, reverse-engineering except where permitted by law, or using the app in violation of applicable laws. The app is licensed to you for personal, non-commercial use on Apple devices you own or control, under Apple's standard licensed-application terms.
7. Intellectual property
The app, its name, logotype, design, algorithms, and content are the developer's property and are protected by applicable intellectual-property laws. These Terms grant you no rights other than the personal license described above. Data you record with the app (your sleep sessions, notes, recordings) is yours.
8. Disclaimer of warranties
The app is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy of sleep analysis, or uninterrupted availability.
9. Limitation of liability
To the maximum extent permitted by applicable law, the developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the app. Where liability cannot be excluded, it is limited to the amount you paid for the app in the twelve months preceding the claim.
10. Changes to the app and these Terms
We may update the app and these Terms from time to time. Material changes will be reflected on this page with a new “Last updated” date; continued use after changes means you accept the updated Terms.
11. Termination
You can stop using the app at any time by deleting it. We may suspend or terminate access to paid features in case of misuse, subject to applicable law and Apple's policies.
12. Relationship with Apple
These Terms are concluded between you and the developer only — not with Apple Inc. (“Apple”). The developer, not Apple, is solely responsible for the app and its content. You acknowledge that:
- Maintenance and support. The developer is solely responsible for providing any maintenance and support for the app. Apple has no obligation to furnish any maintenance or support services for it.
- Warranty. In the event the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app; any other claims, losses, liabilities, or expenses attributable to a failure to conform to a warranty are the developer's responsibility.
- Product claims. The developer, not Apple, is responsible for addressing any claims relating to the app or your use of it, including product-liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims under consumer-protection or similar legislation.
- Intellectual-property claims. In the event of a third-party claim that the app infringes that party's intellectual-property rights, the developer, not Apple, is responsible for the investigation, defense, settlement, and discharge of such claim.
- Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
13. Legal compliance and third-party terms
You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. You must also comply with any applicable third-party terms of agreement when using the app (for example, your wireless data service agreement).
14. Governing law
These Terms are governed by the laws of the Republic of Türkiye, without prejudice to any mandatory consumer protections of your country of residence. Nothing in these Terms limits rights you hold under Apple's media-services terms.
